1. NAME OF THE SOCIETY
The name of the Society registered under the Society Registration Act, 1860 shall be "ASSOCIATION OF CGHS AFFECTED MEMBERS (AOCAM)".
2 REGISTERED OFFICE:
The Registered Office of the AOCAM shall be situated at Plot No. 3-B, Sector-2, Dwarka, New Delhi-75.
3. MEMBERSHIP:
Membership of the AOCAM is open to any person who has attained the age of maturity and fulfils the terms and condition of the AOCAM without discrimination of religion, caste, colour, sex or creed but subject to the approval of the Governing Body of the AOCAM.
4 REFUSAL:
If the membership is not approved by the Governing Body of the AOCAM, the reason of refusal shall be communicated to the person/ applicant concerned.
5. ADMISSION FEE AND SUBSCRIPTION:
The admission fee and the subscriptions shall be as under unless otherwise revised by the Governing Body of the AOCAM:
(a) Admission Fee Rs. 200/- at the time of admission.
(b) Subscription Rs. 100 per month.
6. TERMINATION OF MEMBERSHIP:
The Governing Body of the AOCAM shall have the power to expel/terminate a member or/and members from the membership of the above AOCAM on the following grounds:
(a) On death;
(b) On written resignation;
(c) If found to be insolvent or indulged in any other anti -social activities;
(d) If adjudged by any court of law to be a criminal offender;
(e) If found working against the interest/aims and objectives of the AOCAM;
(f) If fails to pay the subscription or contribution for three months;
(g) If has not attended three consecutive meetings of the AOCAM;
(h) If disregards Rules & Regulations or disobeys the decisions of the Governing Body
7. APPEALS:
All the appeals should be referred to the General Body of the AOCAM. The decision of the General Body shall be final. The reason for rejection of appeal if so shall be communicated to the member concerned.
8. RE-ADMISSION:
In case a member is expelled by the General Body, he/she can be re-admitted provided the member concerned pays all up to dated dues. The decision of the General Body shall be final.
9. GENERAL BODY DEFINITION:
All the members of the AOCAM shall constitute the General Body of the AOCAM.
10. FUNCTION OF GENERAL BODY:
The General Body shall consider any business brought forward by the Governing Body. The General Body Meeting shall be held once in every year regularly. The quorum of General Body meeting shall be 1/3rd of the total strength of the members of the AOCAM. Minimum 15 days notice shall be given to the members before the date of General Body Meetings enclosing agenda specifying date, time, place and issues to be discussed. If the quorum of the General Body is not complete by the schedule time of the meeting, it will be adjourned for one hour to meet the quorum. If the quorum of the General Body meeting is still not complete, the transaction of business of the General Body will start without any want of the quorum.
11. RIGHTS AND PRIVILEDGES OF MEMBERS:
All and every member of the AOCAM shall be entitled to participate in meeting, cultural/ educational functions and other lawful gatherings called/ arranged by the AOCAM and have right to participate in such functions/events after having deposited the required prescribed fee (fixed by the Governing Body of the AOCAM from time to time).
12. DUTIES OF THE MEMBERS:
The members shall elect the Governing Body of the AOCAM. They shall attend the General Body Meeting regularly and give necessary information to the AOCAM pertaining to any matter which is necessary to be known by the AOCAM. They shall not indulge in any activities which are against the aims and objectives and / or the Rules and Regulation of the AOCAM.
13. GOVERNING BODY:
The strength of the Governing Body (including officer bearers and executive member) shall not be less than 7 and not more than 21.
(a) Terms of every Governing Body shall 5 (five) years.
(b) Minimum 7 days notice shall be required for every Governing Body meeting of the AOCAM but urgent Governing Body meeting can be called by 24 Hours notice.
(c) Quorum of every Governing Body meetings shall be 1/3rd of the total strength of the Governing Body. If the quorum of the Governing Body is not complete by the schedule time of the meeting, it will be adjourned for one hour to meet the quorum. If the quorum of the Governing Body meeting is still not complete, the transaction of business of the Governing Body shall start without any want of the quorum
(d) Governing Body meeting shall be held once in three months regularly, (or as and when the Governing Body of the AOCAM may decide from time to time)
14. URGENT MEETING:
The Urgent Governing Body meeting may be called by the 24 Hours notice and the quorum of the same urgent Governing Body meeting shall be as specified in Rule 13 (c).
15. FUNCTIONS & POWER OF GOVERNING BODY:
The Governing Body shall be responsible for the management and administration of all affairs of the AOCAM and is also authorized to appoint any office bearer/ executive member to look after any particular activity. All the decision of the Governing Body shall be taken by the majority votes. It shall have the powers as given to it by the rules and regulations and the General Body. It has powers to prepare plans, projects and programmes for the activities of the AOCAM. It will also have power to appoint the Election Officer to conduct the election of the AOCAM.
16. COMPOSITION OF GOVERNING BODY:
The composition of the Governing Body shall be:-
(a) Convener ONE
(b) Member (Coordination) ONE
(c) Member (Legal) ONE
(d) Member (Public Relations) ONE
(e) Member ( Technical) ONE
(f) Member ( Welfare) ONE
(g) Treasurer ONE
17. POWERS AND DUTIES OF OFFICE BEARERS:
Convener:
The Convener shall summon the meetings of the Governing Body and the General Body of the AOCAM. He shall preside over all the meetings of the AOCAM and the Governing Body. At the time of voting on any matter (except election) if the total votes of the groups of members happen to be equal in number, the Convener shall have the casting vote to decide the matter. The convener shall approve all minutes of the proceedings of Governing Body/ General Body meeting and make his / her signature as mark of his approval.
Member (Coordination):
The Member (Coordination) shall have all the powers of the Convener in his/ her absence and shall prepare the membership register as well as the proceeding register to record the minutes of the proceedings of the Governing Body meetings and the General Body meetings and have them duly signed by the members who attend the meetings.
Member (Legal)
Member (Legal) shall be responsible for all legal matters of the AOCAM.
Member (Public Relations):
Member (Public Relations) shall have all the powers of Member (Coordination) in his / her absence. He shall be responsible for all public relations activities.
Member (Technical)
Member (Technical) shall have all powers of the Member (Public Relations) in his/ her absence. He shall be responsible for all technical matters relating to the activities of the AOCAM.
Member (welfare)
Member (welfare) shall have the powers to coordinate all welfare matters relating to the activities of the AOCAM.
Treasurer
All funds of the AOCAM shall remain under the care, control and management of the Treasurer. The Treasurer shall maintain the accounts of all money received and / or paid by the AOCAM. The Treasure shall make disbursement in accordance with the direction / decision of Governing Body.
18. FILLING UP CASUAL VACANCIES:
Any casual vacancy amongst the Governing Body shall be filled by the resolution passed by the Governing Body. Such appointments shall be confirmed by the General Body in its meeting.
19. ELECTION:
The General body in its Annual meeting will elect its Convener and all the office bearers of the Governing Body after every 5 (five) years by secret ballot papers or by show of hands as may be decided by the Election Officer.
20. SOURCE OF INCOME:
All the income of the AOCAM shall be utilized only for the promotion and fulfillment of the aims and objectives of the AOCAM. Sources of Income of the AOCAM are from admission fee, subscription from the members of the AOCAM, donation and Special Contributions.
21. FINANCIAL YEAR:
Financial year of the AOCAM shall be from 1st April to 31st March of every year.
22. AUDIT:
The accounts of the AOCAM shall be audited by the qualified auditor (Chartered Accountant) every year.
23. MANAGEMENT OF FUNDS & ACCOUNTS OPERATION:
Bank Accounts shall be operated by joint signatures of the Treasurer and the Convener or the treasurer/convener and any one member of the Governing Body.
24. ANNUAL LIST OF GOVERNING BODY:
Once in every year, a list of the Office-bearers of the Governing Body shall be filed in the office of the Registrar of Societies, Delhi as is required under section 4 of Societies Registration Act, 1860.
25. DISSOLUTION:
If the AOCAM needs to be dissolved, it shall be dissolved as per-provisions laid down under the Section 13 and 14 of Societies Registration Act, 1860 as applicable to the National Capital Territory of Delhi.
26. LEGAL PROCEEDINGS:
The AOCAM may sue and / or be sued in the name of Convener as per provision laid down under section 6 of the Societies Registration Act, 1860 as applicable to National Capital Territory of Delhi.
27. AMENDMENT:
Any amendment in the Memorandum, Rules & Regulations will be carried out in accordance with Section 12 & 12-A of the Societies Registration Act, 1860 applicable to the National Capital Territory of Delhi.
28. APPLICATION OF THE ACT:
All the provisions under all the sections of Societies Registration Act, 1860 as applicable to the National Capital Territory of Delhi shall be applicable to the AOCAM.
